AFBCMR BC-2009-00364 MEMORANDUM OF CONSIDERATION OF APPLICATION BEFORE THE AFBCMR SUBJECT: Having carefully reviewed this application, we agree with the recommendation of the Air Force office of primary responsibility and adopt the rationale expressed as the basis for our decision that the applicant has been the victim of either an error or an injustice. Therefore, under the authority delegated in AFI 362603, the applicant's records will be corrected as set forth in the accompanying Memorandum for the Chief of Staff signed by the Executive Director of the Board or his designee. He was not relieved from his assignment and transferred to the Retired Reserve on 1 February 2009, but was continued in his reserve assignment. b. On 16 January 2009, he requested a waiver of his Mandatory Separation Date and his request was approved by competent authority pursuant to Title 10, United States Code, Section 14703, thereby establishing a new Mandatory Separation Date of 1 August 2009. c.
